Blam (the “Service”) is operated by Blam Labs, Inc. (“Blam”, “we”, “us”), a Delaware corporation. By creating an account or using the Service, you (“you”, “your”, a “Customer”) agree to these Terms and our Privacy Policy. If you're using Blam on behalf of a company or team, you represent that you have authority to bind that entity.
You need an email + password, or a Google account, to sign up. You're responsible for anything that happens under your account, including keeping your credentials safe and notifying us if they're compromised.
“Your Content” means anything you upload, create in a Workspace, save to your Library, or write in Memory. You retain all rights to Your Content.
To operate the Service, you grant Blam a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and process Your Content solely to provide, improve, and secure the Service. This license ends when you delete the content or your account — except for residual copies retained for backups, legal compliance, or a short grace period documented in the Privacy Policy.
We do not use Your Content to train third-party foundation models. We may compute aggregate, anonymized analytics to improve Blam.
Don't use Blam to:
Blam uses third-party large language models (currently Anthropic's Claude family) and multimodal services. AI output is generated on request. A few things to know:
Blam indexes publicly available metadata from TikTok and Instagram via managed scraping partners and, where available, official APIs. We respect robots directives, rate limits, and platform Terms to the best of our ability. If you're a creator and want your account excluded from the Viral Database or Account Spy, email optout@useblam.com from a verifiable handle; we process removals within 14 days.
Videos linked from their original platforms are played back via embedded players or thumbnails we cache. Copyright in those videos belongs to the original creators. DMCA takedown requests go to dmca@useblam.com.
We offer a 7-day money-back guarantee from your initial purchase on Solo and Team plans. Email billing@useblam.com with your account email, purchase date, and a reason (optional). Processed within 5–7 business days. Not eligible: purchases more than 7 days old, subsequent renewal cycles (cancel going forward instead), top-up packs after credits have been consumed.
You can delete your account any time. We can suspend or terminate accounts that violate these Terms, threaten the Service's stability, or pose legal risk. Where feasible we'll warn you first. On termination, your Content is deleted per the Privacy Policy; paid, unused service is refunded pro-rata if we terminate for convenience.
The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim, to the maximum extent permitted by law, all warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, uptime, and that viral results will occur from your use of Blam. We make no guarantee that any content you produce with Blam will go viral, stay viral, or avoid being shadow-banned.
To the maximum extent permitted by law, Blam's total liability for any claim arising out of the Service is limited to the greater of (a) the fees you paid Blam in the 12 months preceding the claim, or (b) US$100. Neither party is liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost content, or business interruption — even if advised of the possibility.
You agree to defend, indemnify, and hold Blam harmless against third-party claims arising out of: (i) Your Content, (ii) your use of the Service in violation of these Terms, or (iii) your infringement of someone else's rights. We'll notify you promptly, let you control the defense (with counsel we reasonably approve), and cooperate.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved by binding arbitration administered by the American Arbitration Association in New York, NY, on an individual basis — no class arbitration. Either party may seek injunctive relief in court for IP or unauthorized-access claims. Small claims court remains an option for eligible disputes.
If you're based in the EU, UK, or another jurisdiction with mandatory consumer protections, those protections still apply and override any conflicting term here.
We may update these Terms from time to time. Material changes will be announced at least 30 days before taking effect (via email and in-app banner). Continued use after the effective date means you accept the new Terms. We keep an archive of previous versions at /legal/archive.
